Terms and Conditions

General Terms

The Terms and Conditions set forth following this (hereinafter referred to as “User Terms and Conditions”) apply to your use of the Viding platform that you can access, including but not limited to the site https://viding.co, (hereinafter referred to as the "Viding Platform") which is owned and managed by PT Aku Bisa Ibadah (hereinafter referred to as "Viding"), a limited liability company established under the laws of the Republic of Indonesia, domiciled at Permata Regency D/37, Jl. H. Kelik, RT.1/RW.6, Srengseng, Kec. Kembangan, Kota Jakarta Barat, Daerah Khusus Ibukota Jakarta 11630.

By visiting, using, downloading, and/or installing the Viding Platform, you agree that you have read, understood, accepted, and agreed to these User Terms and Conditions. These User Terms and Conditions constitute a valid agreement between you and Viding.

If you do not agree to one, some, or all of the contents of these User Terms and Conditions, then you are not permitted to use the Viding Platform services and are requested to close your account, and/or delete the Viding Platform from your device.

You represent and warrant that you are an individual legally entitled to enter into a binding agreement under the laws of the Republic of Indonesia, specifically these User Terms and Conditions, to use the Platform and that you are at least 17 years old and not under guardianship. Otherwise, Viding reserves the right under the law to cancel the agreement made with you.

1. Definitions

In these User Terms and Conditions, unless expressly provided otherwise, the terms below have the following meanings:

1. “User Account” means an account owned by the User after the registration process on the Viding Platform is completed;
2. “Service Fee” has the meaning as defined in Article 4.1;
3. “Privacy Policy” is the privacy policy that applies in connection with the use of the Viding Platform which can be viewed at https://viding.co/privacy-policy;
4. “User Content” includes all data, information, text, photos/images, videos, songs, and files uploaded by the User to the Viding Platform.
5. “User” means including but not limited to parties who visit or use the Viding Platform and/or E-Invitation. The term “You” in the General Terms refers to the User;
6. “Viding Platform” is the online platform service available at https://viding.co;
7. “Transaction” means a purchase activity carried out by the User through the Viding Platform or E-Invitation;
8. “E-Invitation” is a website created through the Viding Platform to publish an event; and
9. “Viding” means PT Aku Bisa Ibadah as the owner and manager of the Viding Platform.

2. Terms of Use

1. Users may only use their own account and Users are not permitted to authorize other people to use your identity or use your account. If such authority is given to another person, it is fully the User's responsibility.
2. Viding collects and processes Users' personal information, such as name, electronic mail (email) address, phone number, and others when the User registers. Users are required to provide accurate and complete information, and to update information that may be reasonably requested at any time by Viding.
3. Users are not allowed to misuse or use the Viding Platform for fraudulent purposes or to cause inconvenience to others.
4. A User Account is not permitted to be used by another person if it is already in use.
5. Users are not permitted to harm, alter, or modify the Viding Platform in any way.
6. Viding is not responsible if the User does not have a compatible device. Viding reserves the right to prohibit Users from further using the Viding Platform if the User uses the Viding Platform with an incompatible or unauthorized device or for purposes other than those intended for the use of this Viding Platform.
7. Users understand and agree that their use of the Viding Platform will be subject to our Privacy Policy as may change from time to time. By using the Viding Platform and/or accessing the E-Invitation, Users also give consent as required under our Privacy Policy.
8. If Users use the features available on the Viding Platform, Users understand and agree to all terms and conditions specifically regulated in connection with said feature. All matters that have not been and/or are not regulated in the special terms and conditions of the feature will fully refer to Viding's general terms and conditions.

3. User Content

1. In using any feature and/or service of Viding, Users are prohibited from uploading or using words, comments, images, or any content that contains elements of SARA (Ethnicity, Religion, Race, and Inter-group Relations), discrimination, demeaning or cornering others, vulgarity, threats, advertising, or other matters that may be considered not in accordance with social values and norms or based on policies determined solely by Viding.
2. Users are fully responsible for the truth, privacy, and security of the data uploaded to the Viding Platform.
3. Users are not allowed to include links/other invitation links into the Viding Platform.
4. Users guarantee that they do not violate intellectual property rights in uploading any form of content to the Viding Platform. Users grant Viding a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise any and all copyright, publicity, trademark, database rights, and intellectual property rights that Users have in the content, in any media known now or in the future. Furthermore, to the fullest extent permitted by applicable law, Users waive their moral rights and promise not to assert such rights against Viding.
5. Users understand and agree that violations of content, music, data, information, and photos/images uploaded by the User or the E-Invitation creator are the personal responsibility of the User. Viding reserves the right to take necessary actions for violations of these provisions, including content removal, account moderation, account closure, and others if necessary.
6. Viding is not responsible for losses arising from the misuse of content uploaded by the User or third parties using the User's account.

4. Service Fees

1. Users understand and agree that Viding may charge Users a fee for the services provided by Viding for each Transaction (“Service Fee”). This service fee is imposed for system maintenance and service improvement purposes.
2. The amount of the Service Fee will be determined further by Viding on a separate page which is an integral and inseparable part of these User Terms and Conditions.

5. Warranties

1. Viding makes no representation, warranty, or guarantee for the reliability, timeliness, quality, suitability, availability, accuracy, or completeness of the Viding Platform including (but not limited to) content and services obtained or originating from Users.
2. Viding does not warrant that (a) the use of the Viding Platform will be secure, timely, uninterrupted, or error-free or operate in combination with any other hardware, software, system, or data, (b) any stored data will be accurate or reliable, (c) the quality of any products, applications, information, or other materials obtained by the User through the Viding Platform will meet the User's needs or expectations, (d) errors or defects in the Viding Platform will be corrected, or (e) the application or the server(s) that make the Viding Platform available are free of viruses or other harmful components.
3. The Viding Platform is provided to you strictly on an "as is" basis. All conditions, representations, and warranties, whether express, implied, statutory, or otherwise, including (but not limited to) fitness for a particular purpose, or non-infringement of third-party rights, are hereby excluded and disclaimed to the highest and maximum extent.
4. Users acknowledge and agree that the entire risk arising out of the User's use of the Viding Platform and/or **Event Website** remains solely and entirely with the User and the User shall have no right to claim any compensation from Viding.

6. Limitation of Liability

1. Users understand that Viding is not involved and is not the creator of User Content displayed on the **Event Website** and the Viding Platform.Thus, Viding has no power over the truth, quality, accuracy, or security of the User Content on the Viding Platform. Users release Viding from all forms of responsibility for or all or part of the losses experienced and/or incurred by the User.
2. Viding is obliged to maintain the security of the information provided by Users by implementing the most optimal security system. However, it is still possible for losses or leaks to occur due to illegal acquisition by other parties. Thus Viding does not represent or warrant that the Viding Platform is free from the threat of loss or leakage of information caused by other parties, which is also experienced by all internet users, including but not limited to: (i) carding; (ii) cracking; (iii) phishing; (iv) malware; or (v) other matters, aimed at both the Viding Platform and its supporting infrastructure. Therefore, Users hereby declare that they understand the risks that may arise related to this and release Viding from all forms of responsibility for all or part of the User's losses or loss of profits in connection with the leakage of information due to illegal acquisition by other parties or caused by disruptions, errors, inaccuracies, or virus infections in the Viding Platform.

7. Intellectual Property Rights

Viding, including its name and logo, images, content, features, software protected by copyright, trademark, and other rights provided under the laws of the Republic of Indonesia. Viding (and our licensors, as applicable) exclusively own all rights, title, and interest in and to the Viding Platform, including all related intellectual property rights. Users are only permitted to use Viding's intellectual property rights for personal and not for commercial purposes.

8. Privacy Policy

Users can access the Privacy Policy via https://viding.co/privacy-policy. By using the Viding Platform, Users are deemed to agree to the Privacy Policy and grant Viding the right to use User information contained on the Viding Platform for the benefit of Viding Platform development and Viding's commercial interests, including but not limited to portfolios and other Viding channels, as long as permitted by laws and regulations.

9. Partner Commission and Withdrawal

Commissions can be earned by partners when all package payments have been fully paid by the user/couple. Commission withdrawals will be processed within 1-3 working days after the Partner submits a commission withdrawal request via the Partner Dashboard (National Holidays and Saturdays & Sundays are not counted). Partner commission withdrawals can be made if the name, account number, and bank match the partner's identity and that registered by the partner with Viding. The KYC and verification process will be carried out by the Viding team, and the Viding team has the right to delay and/or suspend if there is a data mismatch or actions that are indicated to violate the rules, laws, and regulations in effect in the territory of the Republic of Indonesia.

10. Miscellaneous

1. These User Terms and Conditions are governed by and construed based on the laws of the Republic of Indonesia. Users agree that any legal action or dispute that may arise from, relate to, or be in any way connected with the site and/or these Terms and Conditions will be resolved exclusively within the jurisdiction of the courts of the Republic of Indonesia.
2. These User Terms and Conditions may be modified and changed from time to time. Viding will notify Users via the Viding Platform and/or email of modifications and/or changes to the User Terms and Conditions. Your continued use of the Viding Platform after receiving this notice constitutes your consent and acceptance of the modifications and/or changes. If Users are not willing to be bound by the new User Terms and Conditions, Users may request the closure of their User Account by sending an email to [email protected].
